DLM03814 Nicole Padilla wipes away tears as she stands outside a Adams County courtroom after Jonathan Ardoline, 25, the man accused of killing her mother Katrina Padilla in a drunk driving crash, waived his preliminary hearing Wed., Sept. 6, 2006 in Brighton, Colo. The crash happened May 28, 2006 on 92nd Avenue in Federal Heights. Police found bottles of alcohol on the scene and Ardoline's BAC was tested at .29, more than three times the legal limit, three hours after the crash. More than a dozen of Padilla's family members were at the courthouse Wednesday wearing t-shirts with photos of Padilla on the front. Ardoline will now be arraigned Oct. 11, 2006 on charges of felony vehicular homicide and driving under the influence. The Padilla family attorney Chad Hemmat sent out a press release Tuesday Sept. 5, 2006 that showed in posts from August Ardoline's described himself on his myspace.com site as "a hard partier and smoking weed everyday."
