LAWSUIT FILED
CHUN Opposes Motor Bank
On July 16 CHUN filed a lawsuit in
Denver District Court challenging the
decision of the Board of Adjustment
Zoning, which upheld the decision of the
Zoning Administration allowing United
Bank to erect-a 21-unit motor bank in
the 1700 block of Grant Street.
The zoning administrator, Anthony
Jansen, had approved a permit application on the basis that the motor bank
was an addition to an existing bank
accessory use.
CHUN had appealed Mr. Jansen!s decision
to the Board of Adjustment and Zoning
and appeared at a hearing before the
board in May. The board denied the
appeal, but did find that CHUN had legal
standing to challenge the decision.
The finding as to legal standing was a
minor victory, because CHUN's ability
to bring a lawsuit as a neighborhood
group had been challenged.
CHUN's position in the lawsuit is that
a motor bank is not a use by right or
a valid accessory use in an R-4 zone.
The relief requested includes an order
requiring the cessation of construction
(which is ongoing) and to reverse the
decision of the Board of Adjustment Zoning.
Community Opinions Sought On Local Zoning Issues
Someday you may be given a leaflet that
asks for your help in determining CHUN's
position on a zoning issue near your
home.
In an effort to better represent the
residents of the neighborhood, CHUN is
taking major zoning issue decisions to
the neighbors. We are leaf letting the
neighborhoods where developments are
proposed, inviting local residents to
join us at meetings where the proposal
is discussed and opinions can be expressed. Neighborhood sentiment mixed
with the expertise of the zoning and
land use committee then determines
CHUN's position on the development.
CHUN will continue to strive to represent the neighborhood as responsibly
as possible.
This is a new process on which we are
still working. If you have ideas that
will help us fetermine and incorporate
local views in the positions that CHUN
takes, please share them with us.
